Vivacity Tech PBC provides technology equipment, software and related services to the education sector. We understand that your privacy is an important part of the trust you place in us.

This privacy policy (“Policy”) explains how Vivacity (“Vivacity Tech,” “our,” “us,” or “we”) may collect, use, disclose, and otherwise process information collected in connection with Vivacity Tech services, websites and online activities (collectively, “Sites”).

Information Collected

Information You Provide
We collect information you provide when you use our Sites from one or more devices associated with you, or that you provide in any other way, including over the phone or on paper. For example, we may collect your name, work title, email address, postal address, phone number and demographics about your school or district (such as number of students). If you make a purchase from our Sites, we will collect payment and order information, user ID, password, and other information you may provide on our Sites, such as when you complete a transaction, register for an account, log in to our Sites, subscribe to or request our services, or contact our customer service representatives.

Information from Other Sources
We may also obtain information about you from other sources and combine that with information we collect either on our Sites or directly from you. As examples, we may obtain demographic data from third-party data providers to better market to you, or we may purchase or lease lists from list brokers to correct or supplement information about you.

Information Automatically Collected – Cookies & Similar Tracking Technologies
When you visit our Sites, some information about your visit is automatically collected, such as your device’s operating system, application software, Internet Protocol (IP) address, access times, browser type and language, peripherals, user log data, Active Directory information, and the websites you visited before and after our Sites. We also collect (directly or via third parties) information about your usage and activity on our Sites, including information about your orders, purchases, and cart activity through essential and non-essential cookies, Web beacons, and similar tracking technologies (collectively, “Cookies”).

We may retain your personal data as necessary for the purposes described in this Policy, in accordance with Vivacity Tech’s record retention practices. When we no longer need your information we will, unless it is needed to comply with applicable legal requirements, remove your personal data and/or take steps to anonymize it.

 

Sharing Your Information
Ways we may share your information with third parties as follows:

  • Third Party Vendors/Service Providers.  We may rely on third-party vendors, consultants and other service providers to perform functions on our behalf and under our instructions in order to make our Sites available to you. For example, we may engage vendors/service providers for auditing, compliance, and product delivery functions
  • Vivacity Tech Suppliers. We may share your information with suppliers to Vivacity Tech for their internal purposes including administrative purposes, as well as to improve performance, products and services; and for purposes relating to proposed or completed transactions facilitated by Vivacity Tech;
  • Business Partners. We may share your information with third parties with whom we do business, including to facilitate your purchase of a product manufactured by a Vivacity Tech partner, or for their own marketing purposes in compliance with applicable laws and subject to their separate privacy policies;
  • Legal Obligations and Rights.  In connection with: (i) the establishment, exercise, or defense of legal claims; (ii) to comply with laws or to respond to lawful requests and legal process; (iii) to protect the rights and property of Vivacity Tech, our agents, customers, and others, including to enforce our agreements, policies, and terms of use; (iv) to detect, suppress, or prevent fraud; (v) to reduce credit risk and collect debts owed to Vivacity Tech; (vi) an emergency to protect the personal safety of Vivacity Tech, its customers, or any person; or (vii) as otherwise permitted by applicable law.
  • Business Reorganization. In connection with or during negotiation of any merger, sale of company assets, financing, or acquisition of all or a portion of our business to another company.
  • Consent. We may share your information for any other purposes with your consent.

We may also share aggregated or anonymized information in a form that does not directly identify you.

 

Security of Your Personal Data
Vivacity Tech takes reasonable technical, physical, and administrative steps to help protect your personal data in our custody or control from loss, misuse and unauthorized access, disclosure, alteration and destruction. Where you have chosen a password which enables you to access certain parts of our Sites, you are responsible for keeping this password confidential. We ask you not to share a password with anyone or to reuse the same user ID and password on other sites.

 

Third Party Websites
Except for Vivacity Tech’s own online activities on third-party websites and online services where we post our Policy, this Policy does not apply to, and Vivacity Tech is not responsible for, any other data practices of third-party websites and online services or the practices of other third parties. Social Networks and Accounts
Our Sites may allow you to sign into and associate your social network accounts with Vivacity Tech, including, but not limited to, Twitter, LinkedIn, and Facebook. By using this functionality, you give Vivacity Tech permission to access all of the elements of your social network profile information that you have made available to be shared and to use it in accordance with the social network’s terms of use and this Policy. Please refer to the privacy settings in your social network account for information about what information is shared with Vivacity Tech and other connected applications and to manage the information that is shared through your account, including information about your activities using our Sites.

 

Children’s Privacy
Our Sites are general audience sites intended for business and governmental purchasers. Our Sites are not directed at children under the age of 13. If we obtain actual knowledge that any information we collect has been provided by a child under the age of 13, we will promptly delete that information.

 

Your Rights and Choices

Email and Marketing Choices
You may ask us not to process your personal data for marketing purposes. In some jurisdictions, you also have the right to opt-out of the disclosure of your personal data to third parties for the third parties’ direct marketing purposes. You can exercise your right to prevent such processing by: (i) following the opt-out instructions in promotional emails; (ii) checking certain boxes on the forms we use to collect personal data; and (iii) for email marketing, by visiting your account settings our website. You may also make requests about your contact preferences and changes to your information by contacting your account manager. By accessing or otherwise using the Vivacity Tech PBC website vivacitytech.com (the “Site”) you agree to be bound by these terms and conditions of use and any other applicable end-user agreements.

 

Changes to the Terms and Conditions
Vivacity Tech may change these terms and conditions of use at any time, without prior notice. If you access or use the Site after Vivacity Tech posts a change, you accept that change. If you do not accept the change, do not access or use the Site. You should check these terms and conditions of use periodically.

 

Access and Use of the Site
Vivacity Tech grants you a limited license to access and use the Site, including to display, copy, distribute and download its content, only for your personal, non-commercial use and provided that you do not modify the Site, its content, or any copyright or other proprietary notices. All orders are subject to product availability. Therefore, Vivacity Tech cannot guarantee that it will be able to fulfill customer’s orders.

How Do I Contact You?

How Much Does Shipping Cost?
Shipping costs are calculated at the time of checkout. Costs vary based on product, quantity and location.Overnight shipping is calculated at the time of checkout. You may contact customer service for a quote.Bulk orders or orders containing large volumes of parts may ship via LTL Freight. In that event, a Customer Success representative will contact you to request additional details.

 

How Long Will It Take for My Order to Reach Me?
If your ordered items are in stock, you will usually receive a shipping notification within two business days. If you do not receive a notification in that time frame, your items may not currently be in stock. If you have any questions about the status of your order, please contact our Customer Success team.We are located in Saint Paul, Minnesota, USA. In stock orders will usually arrive within 1-7 business days of shipment depending on location and shipping service.

 

Do You Provide Tracking Information?
A tracking number is provided in your shipping confirmation email, which will be sent to the email address listed on the account from which you ordered.Please check your spam folder as shipping confirmation may be located there. Also, please make sure that your email address entered correctly at checkout.

 

How Late Do You Ship?
Our daily shipping window closes at 3:00pm US Central Time. Orders received after this time will be shipped the next day if the products are in stock.

 

Can I Cancel My Order?
You can cancel an order at any time, as long as the shipment has not left our warehouse. Please contact Customer Service if you wish to cancel an order.

 

What if My Shipment Gets Lost or Damaged?
If your package arrives damaged, please take photos and contact us immediately. Customer satisfaction is our top priority and we will do everything we can to ensure you receive quality products.

 

Why Has My Shipment Been Split Into Multiple Shipments?
To better service our clients, we ship what is available in our inventory to you as quickly as we can. Multiple shipments are only available for U.S. orders.

LAND ACKNOWLEDGMENTS

Land Acknowledgments are efforts made to name who originated from the land we are currently on, and to respect Indigenous belonging and history. These are developed from Itzel Calvo Medina in their piece “A STUDENT GUIDE FOR COMMUNITY ORGANIZING.

 

St. Paul
We would like to offer a Land Acknowledgment. Vivacity Headquarters (HQ) sits on the traditional territory of the Cree and Métis peoples, as well as the Sioux, Crows, and Blackfeet peoples who were scattered throughout the Northern Plains. By offering this land acknowledgment we affirm Indigenous sovereignty and would like to commit to holding the Twin Cities, the city of St. Paul and Minneapolis, as well as the state of Minnesota more accountable to the demands of American Indians, Native Americans, and Indigenous People. We must remain critical of the kind of relationship we have with the land. While recognizing the importance of renaming buildings that were named after colonizers, supporting Indigenous activists and organizations, and offering land acknowledgments, we must also sit with knowing that this is not enough. We must educate ourselves on the original people of this land and offer our support in the actions we take.

 

Chicago
We would like to offer a Land Acknowledgment. Vivacity in Chicago sits on the traditional territory of Peoria, Bodwéwadmi (Potawatomi), Myaamia, Kaskaskia, Kiikaapoi (Kickapoo) peoples. By offering this land acknowledgment we affirm Indigenous sovereignty and would like to commit to holding Greenville, as well as the state of South Carolina more accountable to the demands of American Indians, Native Americans, and Indigenous People.
